Terms of Service
Last updated: March 2025. These Terms of Service (“Terms”) govern your use of the GiftMate platform and related services operated by GiftMate INC (“we,” “us,” or “our”).
1. Acceptance of Terms
By accessing or using GiftMate, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. Description of Service
GiftMate is an AI-powered gift recommendation platform. We provide tools to create profiles for gift recipients, chat with an AI to get personalized gift ideas, save recommendations, and access links to products from third-party retailers. Some recommendation links are affiliate links; when you make a qualifying purchase through such links, we may receive compensation. This does not affect the price you pay.
3. Account Registration and Use
You may need to create an account to use certain features. You are responsible for keeping your account credentials secure and for all activity under your account. You agree to provide accurate information and to update it as needed. You must be at least 18 years old (or the age of majority in your jurisdiction) to use the service.
4. Acceptable Use
You agree to use GiftMate only for lawful purposes and in accordance with these Terms. You may not: (a) use the service in any way that violates applicable laws; (b) attempt to gain unauthorized access to our systems or other users’ accounts; (c) use the AI or other features to generate harmful, abusive, or illegal content; (d) scrape, reverse engineer, or attempt to extract source code or data from the service beyond normal use; (e) resell or commercially exploit the service without our permission; or (f) interfere with the operation or security of the service. We may suspend or terminate accounts that violate these terms.
5. Intellectual Property
GiftMate INC owns or licenses the content, design, and technology underlying the GiftMate platform. You do not acquire any ownership rights by using the service. You may not copy, modify, or create derivative works of our service or content without our written permission.
6. Disclaimers
The service is provided “as is” and “as available.” We do not guarantee that recommendations will be accurate, that the service will be uninterrupted or error-free, or that third-party product links will be available or correct. Gift recommendations are suggestions only; we are not responsible for your purchases or your relationships with third-party retailers.
7. Limitation of Liability
To the fullest extent permitted by law, GiftMate INC and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the service. Our total liability for any claims arising from these Terms or the service shall not exceed the amount you paid us, if any, in the twelve months preceding the claim, or one hundred U.S. dollars, whichever is greater.
8. Termination
We may suspend or terminate your access to the service at any time, with or without cause or notice. You may stop using the service at any time and may close your account through your account settings or by contacting us. Provisions that by their nature should survive (including disclaimers, limitation of liability, and governing law) will survive termination.
9. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from these Terms or the service shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
10. Changes to the Terms
We may update these Terms from time to time. We will post the updated Terms on this page and indicate the date of the last update. Your continued use of the service after changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the service.
